STARTING YOUR CASE
What this service involves
We begin by reviewing your immigration history, eligibility, documents and goals. This helps us determine whether the standard service described here fits your situation and what evidence will be needed.
PREPARING YOUR RECORD
Typical documents we review
The exact documents depend on your history, eligibility and the filing requirements.
- Immigration Judge's written or oral decision
- Available court record and hearing documents
- Existing evidence and prior legal submissions
LEGAL PREPARATION
How we prepare the case
We assess appealable issues, prepare the BIA notice and substantive appellate brief, and monitor the appeal through the Board's decision within the agreed scope.
We explain the filing plan and any case-specific concerns before the representation begins.
FLAT-FEE SCOPE AND LIMITATIONS
What is included and what costs extra
Flat attorney fee for one standard appeal to the Board of Immigration Appeals (BIA) from a decision of an Immigration Judge, through the Board's decision. Includes review of the Immigration Judge's decision and available record; evaluation of appealable issues; preparation and filing of Form EOIR-26, Notice of Appeal; Form EOIR-27, Notice of Entry of Appearance before the BIA; legal research; one principal appellate brief; routine filings using ECAS when available; and routine case monitoring through the Board's decision. Excludes government filing fees; transcript expenses and extensive record retrieval; translations; emergency stay-of-removal requests; bond appeals; unusually complex criminal or jurisdictional issues; oral argument; extensive supplemental briefing; motions to reopen or reconsider; and federal court petitions for review. The standard scope and applicable filing deadlines are confirmed in a written engagement agreement. Where applicable, responses to Requests for Evidence (RFEs) relating to the covered matter are included in the flat attorney fee. Any USCIS Notice of Intent to Deny (NOID) response arising from this covered application or representation, like a related Request for Evidence (RFE) response, is included in the stated flat attorney fee at no additional attorney charge.
The signed representation agreement controls the exact scope. Government fees and outside costs, where applicable, are not included unless expressly stated.
COMMON QUESTIONS
Before we begin
Are government filing fees included in the price?
No. The displayed amount is the attorney fee. USCIS, consular, medical, translation and other third-party charges, when applicable, are separate unless the specific scope expressly says otherwise.
Will you charge an extra attorney fee if USCIS sends an RFE or NOID?
No additional attorney fee is charged for RFE or NOID responses arising within a Green Chavez matter already covered by a flat-fee representation agreement. The separately priced RFE and NOID services are only for new clients with applications filed independently or by another firm.
How do I find out whether my case fits this standard fee?
Contact our office for a case-specific eligibility and scope review. If your situation falls outside the listed service, we will explain the additional work and fees in writing before you hire us.
