STARTING YOUR CASE

What this service involves

We begin by reviewing your immigration history, eligibility, documents and goals. This helps us determine whether the standard service described here fits your situation and what evidence will be needed.

01

PREPARING YOUR RECORD

Typical documents we review

The exact documents depend on your history, eligibility and the filing requirements.

  • Certified criminal dispositions when available
  • Immigration history and inadmissibility information
  • Rehabilitation or qualifying-relative hardship evidence
02

LEGAL PREPARATION

How we prepare the case

We analyze the statutory waiver route and restrictions, develop the discretionary record and prepare Form I-601 or the appropriate waiver submission with legal argument.

We explain the filing plan and any case-specific concerns before the representation begins.

03

FLAT-FEE SCOPE AND LIMITATIONS

What is included and what costs extra

Flat attorney fee for one standard stand-alone INA Section 212(h) criminal inadmissibility waiver package, without Immigration Court hearing appearances or ongoing removal-defense representation. Includes review of criminal dispositions and immigration history; eligibility and statutory-restriction analysis; rehabilitation or qualifying-relative hardship assessment as applicable; declarations and discretionary-equities evidence; legal research; one substantive legal brief; Form I-601 when required or an appropriate waiver application package; ordinary exhibits; filing with the appropriate agency or tribunal; and routine case tracking. Excludes government fees, obtaining certified court records and extensive FOIA records, translations, expert evaluations, complex aggravated-felony or multiple-conviction litigation, other inadmissibility grounds, underlying adjustment or consular applications, Immigration Court appearances and ongoing removal defense, motions, appeals. Procedures and 212(h) eligibility depend on the individual facts and adjudicating forum. This specialty service is separate from the standard $6,500 I-601 hardship waiver and $9,000 non-detained EOIR defense; it is not an automatic surcharge. Where applicable, responses to Requests for Evidence (RFEs) relating to the covered matter are included in the flat attorney fee. Any USCIS Notice of Intent to Deny (NOID) response arising from this covered application or representation, like a related Request for Evidence (RFE) response, is included in the stated flat attorney fee at no additional attorney charge.

The signed representation agreement controls the exact scope. Government fees and outside costs, where applicable, are not included unless expressly stated.

COMMON QUESTIONS

Before we begin

Are government filing fees included in the price?

No. The displayed amount is the attorney fee. USCIS, consular, medical, translation and other third-party charges, when applicable, are separate unless the specific scope expressly says otherwise.

Will you charge an extra attorney fee if USCIS sends an RFE or NOID?

No additional attorney fee is charged for RFE or NOID responses arising within a Green Chavez matter already covered by a flat-fee representation agreement. The separately priced RFE and NOID services are only for new clients with applications filed independently or by another firm.

How do I find out whether my case fits this standard fee?

Contact our office for a case-specific eligibility and scope review. If your situation falls outside the listed service, we will explain the additional work and fees in writing before you hire us.
